I’d imagine it would be up to the theme designer as to whether the functions go in or not - then again, like gravatars, it will presumably be a stipulation of inclusion on WP Themes.

Alibi is a 2 column fixed-width, free WordPress theme, with righthand sidebar, enabled for widgets.
There’s only one option in the admin panel - choose any color for the links/headings (the screenshot and demo show the bright red version). The horizontal menu is for top-level pages, sorted in wordpress menu order.

So what of the relatively vast and ever-growing number of sites that republish the themes produced, usually scraping the links directly off weblogtoolscollection news. Some are just doing it for the content, others are considerably more naughty and modify the packages, adding their own links…. the wonders of Open Source…
